In this interview, UBC Graduate School of Journalism adjunct professor Dan Burnett explains the impact of the ruling by a Canadian court that linking does not amount to publication.
Prof. Burnett was the lawyer for Jon Newton, the publisher of p2pnet.net. He stood accused of defamation on the ground that his site contained links to allegedly defamatory material. But B.C. Supreme Court judge Stephen Keller dismissed the libel case, ruling that hyperlinks, are analogous to footnotes, and cannot be consider a publication.
